Terms of Use
These Terms of Use ("Terms") govern your use of Duner. Duner is a search and information platform that helps you find and compare vacation rentals, experiences, beach-equipment rentals, and other travel-related services — it is not a booking site, and it does not itself provide the rentals, experiences, equipment, or other third-party services shown on the site. By accessing or using Duner, you agree to these Terms.
The short version: Duner doesn't charge you a fee, and it doesn't take your booking or your payment — those happen with the provider, under the provider's terms, so questions and disputes about a booking go to them. These Terms are governed by Virginia law. The sections below are the full text, and they are what actually applies.
Who we are
Duner is operated by Duner Beach Media LLC, a Virginia limited liability company doing business as Duner Beach ("Duner," "we," "us," "our"). Our registered office is 8401 Mayland Dr, Suite S, Richmond, VA 23294. You can reach us at hello@dunerbeach.com.
What Duner is — and isn't
Duner is a search and information tool. We display listings, availability, prices, and other information for vacation rentals, experiences, and other travel-related services, and we link you to the rental company, booking platform, experience provider, or equipment vendor that offers them. Duner does not sell, rent, or book anything. Specifically, Duner is not:
- a booking site, travel agent, tour operator, or property manager;
- a party to any reservation, rental, or purchase you make with a provider;
- an escrow, payment processor, or merchant of record for any transaction.
In these Terms, a "provider" means any third party whose offerings appear on or are linked from Duner — including local rental companies, booking platforms and marketplaces, activity and tour operators and platforms, equipment vendors, and other referral partners. Any booking or purchase you make is completed directly with the provider — through the provider's website, booking platform, by phone, or through another method the provider offers — under that provider's terms. Your contract for that transaction is between you and the provider, not Duner.
Where Duner sends you
Duner shows results from different kinds of providers and labels the destination so you know where you're going:
- Book direct — the result is offered by the local business behind it. Home results carry a "Book on <company>" button to that rental company's own website; beach-gear results link to each local operator's own website or phone number.
- Marketplace — the result is offered through an activity marketplace, tour operator, or booking platform. Experience cards are badged "via Viator" or "via GetYourGuide", and national beach-gear options are badged "Marketplace". The result sends you to that marketplace's or provider's own listing, booking platform, or other contact method shown by Duner.
The same property or experience may be available from more than one source, sometimes at different prices or on different terms. We show what we have and label the destination; the price and terms that apply are those the provider quotes or displays when you complete the transaction.
Affiliate relationships and how we make money
Some links on Duner are affiliate links. If you click one and complete a booking or purchase, Duner may earn a commission or referral fee from the provider. Duner does not charge you a separate fee for using an affiliate link. Prices, taxes, fees, and other charges are determined by the provider. We identify affiliate results and provide an affiliate disclosure where those links appear. Some links and provider listings are not compensated.
How results are ranked
You can sort and filter results yourself (for example, by price, rating, or location). Compensation does not purchase position — no provider, marketplace, or operator pays for a higher place in Duner's results, and Duner does not sell placement, promoted slots, or featured positions. Compensation does not purchase inclusion either — no provider pays to appear on Duner, and whether a provider is listed does not depend on any payment to us. If either of those ever changes, we will say so here and on the pages where those results appear before it takes effect, and any paid placement will be clearly and conspicuously identified as paid where it appears. Duner does not represent that its results include every provider or every available option.
Accuracy, pricing, and availability
We work to keep information accurate, but listings, prices, taxes, fees, and availability come from third parties and change frequently. Information on Duner may be out of date or contain errors. The provider's current booking information is the source of truth — always confirm the current price, total, availability, and terms with the provider before you book. Where online booking is available, confirm the final terms on the provider's website or booking system. Prices may be shown before or after taxes and fees depending on how the provider presents them, and we label these where we can.
Duner does not represent that its results include every available property, experience, provider, rate, or option — results depend on the information and inventory available to us from participating or accessible sources — and we do not guarantee that any price displayed on Duner is the lowest available price. Information may be cached, delayed, incomplete, or temporarily inconsistent with the provider's current information. Duner does not independently inspect, operate, manage, insure, or control the properties, activities, equipment, businesses, or providers displayed on the site, and inclusion on Duner is not a guarantee of quality, safety, licensing, insurance, legality, or suitability.
Bookings, changes, cancellations, and support
Because Duner is not a party to your booking and does not provide or control the rental, experience, equipment, or other service, everything about the transaction is handled by the provider, not by us — including payment, confirmation, changes, cancellations, refunds, deposits, property or activity conditions, safety, and customer service. Duner cannot process or resolve booking changes, cancellations, refunds, service complaints, or other transaction disputes — disputes concerning the transaction itself or the provider's performance should be addressed with the provider or booking platform with which you transacted.
Third-party sites and terms
When you follow a link from Duner, you leave our site and become subject to the destination's own terms of use and privacy policy. We don't control those sites and aren't responsible for their content, practices, or the products and services they offer. Our handling of your information is described in our Privacy Policy.
Acceptable use
You may use Duner only for lawful purposes and in accordance with these Terms. You agree not to:
- scrape, harvest, or systematically extract content or data from Duner, including through automated means, except as expressly permitted by Duner or applicable law;
- republish, resell, or redistribute Duner's content or provider content shown on Duner, except as permitted by applicable law or with the applicable rights holder's permission;
- interfere with, overload, or attempt to gain unauthorized access to the site or its systems; or
- use Duner in any way that is unlawful or that infringes anyone's rights.
Intellectual property
The Duner name, logos, site design, software, and original content are owned by or licensed to Duner Beach Media LLC and are protected by applicable intellectual-property laws. Third-party names, trademarks, photographs, descriptions, listing information, and other content remain the property of their respective owners or licensors; display of that content on Duner does not transfer any ownership rights to you. Except as permitted by law or with the applicable rights holder's permission, you may not reproduce, redistribute, republish, sell, or commercially exploit content obtained through Duner. Copyright concerns are handled through our Copyright & DMCA Policy.
Site availability and changes
Duner may add, remove, modify, suspend, or discontinue features, results, providers, content, or portions of the site from time to time. We do not guarantee that any particular provider, listing, feature, or service will remain available on Duner.
Disclaimer of warranties
Duner is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties regarding the accuracy, reliability, availability, or completeness of the site or of any listing, price, availability, or other information shown on it. We do not warrant that the site will be uninterrupted or error-free. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
Limitation of liability
To the maximum extent permitted by law, Duner Beach Media LLC and its parent, affiliates, members, managers, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenues, or data, arising out of or relating to your use of (or inability to use) Duner, or to any booking, product, service, or provider you find through Duner, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for any claim relating to Duner will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the limitations above may not apply to you.
Indemnification
You agree to indemnify and hold harmless Duner Beach Media LLC, its members, managers, officers, employees, and agents from claims, damages, liabilities, and reasonable expenses (including reasonable attorneys' fees) arising from your unlawful or unauthorized use of Duner, your violation of these Terms, or your infringement of another person's rights.
Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. You agree that any dispute relating to Duner or these Terms will be brought exclusively in the state or federal courts located in Virginia, and you consent to their jurisdiction.
General
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision of these Terms does not waive our right to enforce it later. These Terms constitute the entire agreement between you and Duner regarding your use of the site, except to the extent another written agreement between you and Duner applies.
Changes to these Terms
We may update these Terms from time to time. When we do, we'll revise the "last updated" date above. Your continued use of Duner after a change means you accept the updated Terms.
