Copyright & DMCA Policy

Duner respects the intellectual-property rights of others and expects the businesses and marketplaces it links to do the same. Duner is a search and directory service: it links to listings on rental companies' own sites and on third-party marketplaces, and displays limited descriptive material — titles, images and summaries — that those marketplaces supply through their partner interfaces. Duner does not host material uploaded by users, and it has no user accounts. If you believe material Duner links to or displays infringes your copyright, please notify our designated agent. We will respond to valid notices in accordance with the Digital Millennium Copyright Act ("DMCA").

How to report a copyright concern

Send a written notice to our designated agent (below) that includes the following information. Because Duner is an information location tool, the governing provision is 17 U.S.C. § 512(d), which adopts the notice elements of § 512(c)(3)(A) with the identification pointing at the reference or link rather than at stored material:

1. Your physical or electronic signature.
2. Identification of the copyrighted work you claim has been infringed, or a representative list if your notice covers multiple works on Duner.
3. Identification of the material, reference, or link you claim is infringing, together with information reasonably sufficient for us to locate it — ideally the exact URL(s) on Duner.
4. Information reasonably sufficient for us to contact you, such as your mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

If a notice substantially complies with the DMCA's requirements, Duner will respond expeditiously to remove or disable access to the link or listing identified in the notice. Duner cannot remove material from the site it links to; where the material is on someone else's site, the notice also needs to reach them. We may forward the notice, including your contact information, to the marketplace, company, or other person responsible for the material. If a notice is incomplete but provides enough information for us to identify the copyrighted work, locate the material, and contact you, we may contact you to request the missing information.

Notices of claimed copyright infringement should be sent to Duner's designated agent:

Duner's designated agent is registered with the U.S. Copyright Office and listed in its DMCA Designated Agent Directory.

Repeat-infringer policy

It is Duner's policy, in appropriate circumstances, to terminate or restrict the access of any person or business whose material Duner links to or displays, where that source is a repeat infringer. Duner offers no user accounts and has no subscribers, so there is no account to close: terminating access here means removing a source's listings and ceasing to link to it. Duner also accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, as required by applicable law.

If we removed a link by mistake

If a link or listing was removed because of a notice you believe was mistaken, tell our designated agent. Because Duner links rather than hosts, this is not the § 512(g)(2) counter-notification procedure that applies to stored content — but the substance is the same, and a written statement containing the following lets us act on it quickly:

1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number, together with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Duner may be found), and that you will accept service of process from the person who submitted the original notice or that person's agent.

We will review it promptly and restore the link or listing if the removal was mistaken. We may provide your statement, including your contact information, to the person who submitted the original notice. If they tell us they have filed an action seeking a court order about the material, the link stays down while that is resolved.

Misrepresentations

Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material or activity is infringing — or that material was removed or disabled by mistake or misidentification — may be liable for resulting damages, costs, and attorneys' fees. Please submit notices and counter-notifications only in good faith.
